Tort Law

     Depending on the circumstances, you may be able to claim the following grounds in tort law for workplace bullying, harassment, victimisation, discrimination, or other unethical or incompetent conduct in your APS agency:
  • misfeasance in public office;
  • breach of statutory duty;
  • breach of duty of care to provide a safe system of work;
  • intentional infliction of mental harm and emotional distress;
  • negligence;
  • invasion of privacy;
  • trespass or assault.

Contract Law

      Depending on the circumstances, where an issue of workplace bullying, harassment, victimisation or discrimination is inadequately addressed by your APS agency, you may be able to claim a breach of express or implied terms of your APS agency's enterprise/collective bargaining agreement or other employment contract.
